Current Practice
Janine Smith specialises in litigation and dispute resolution,
generally within the context of employment & industrial matters.
Janine regularly conducts complex litigation across a broad range of
areas including contractual and commercial disputes, Trade Practices
Act claims and complex debt recovery actions. She has extensive
experience in conducting litigation in superior Courts such as the
Supreme Court of NSW and the Federal Court of Australia as well as
in the District Court of NSW. Janine also has considerable
experience in representing clients involved in disciplinary
proceedings before specialist tribunals. Janine also has expertise
in the area of occupational health and safety, with exposure to both
the prosecution and the defence aspects of OH&S.
Professional Experience
Janine was admitted to legal practice in June 1991 and joined
Carroll & O'Dea as a Solicitor in August 1991.
In 1995 Janine took two years' leave of absence and worked in the
UK as a Locum solicitor for the London Fire and Civil Defence
Authority (London Fire Brigade) defending civil claims brought
against the Authority by employees, members of the public and other
institutions. Janine also worked as a Locum solicitor with UK
Environment Agency prosecuting offences under the Environmental
Protection Act 1990 and the Environment Act 1995.
Since returning to Carroll & O'Dea in 1997, Janine has
continued to consolidate her skills and knowledge in the area of
litigation and dispute resolution, primarily but not exclusively in
the employment context. Janine is an experienced advocate who
appears regularly in interlocutory matters in the Supreme, District,
Local and Chief Industrial Magistrate’s Courts as well as in the
Industrial Relations Commission of NSW.
In the area of compensation law, Janine was awarded Specialist
Accreditation by the Law Society of NSW in 2000. Janine has
extensive experience in the areas of workers compensation,
multi-party common law damages claims, public liability and
professional negligence claims. Janine has also conducted litigation
in the Dust Diseases Tribunal and acted in claims against the State
arising out of Aboriginal deaths in custody and the 'Stolen
Generation'.
Professional Background
Janine has a Bachelor of Arts (First Class Honours) and a Bachelor
of Laws degree from University of Sydney. Janine joined Carroll
& O'Dea in 1991 and became an Associate in 1999. She is an
Accredited Specialist in Personal Injury Law and is a member of the
Australian Lawyers’ Alliance and the Women Lawyers' Association of
NSW. |
